SERAP Sues Buhari Over Failure To Probe Alleged Misuse Of Estimated Yearly N241billion Security Votes By Governors

The Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit against President Muhammadu Buhari over this government’s failure to probe allegations of mismanagement of security votes by governors.

Apart from the Buhari government’s “failure to promptly and thoroughly probe allegations of systemic mismanagement of security votes by state governors since 1999, SERAP is also suing to “ensure the prosecution of those suspected to be responsible”.

Joined in the suit as Respondent is Mr Abubakar Malami, Attorney-General of the Federation and Minister of Justice.

The suit followed Buhari’s 2022 New Year Message in which he raised concerns about “the persistent insecurity in certain parts of the country,” and his promise in his 2015 inaugural speech to “check gross corruption and ensure that there is accountability at all levels of government in the country”.

A statement on Sunday by Kolawole Oluwadare, SERAP Deputy Director, disclosed that the suit numbered FHC/L/CS/189/2022 was filed last week at the Federal High Court in Lagos.

In the suit, SERAP is seeking: “an order of mandamus to compel President Buhari to direct Mr. Abubakar Malami SAN, Attorney General of the Federation and Minister of Justice to probe allegations of systemic mismanagement of security votes by state governors since 1999”.

SERAP is also seeking “an order of mandamus to compel President Buhari to direct Mr. Abubakar Malami (SAN) to prosecute anyone suspected to be responsible, as appropriate; if there is sufficient admissible evidence, and to recover any mismanaged public funds.”

According to the organisation, compelling the Nigerian government to probe the spending of security votes since 1999 would ensure accountability, and improve the ability of the government to deliver on the promises secure the lives of Nigerians.

SERAP is also arguing that, “It is in the interest of justice to grant this application. Ending impunity for allegations of corruption in the spending of security votes and recovering any mismanaged public funds are matters of public interest.”

“The responsibility to guarantee and ensure the security and welfare of the Nigerian people is interlinked with the responsibility under Section 15(5) of the Nigerian Constitution, 1999 [as amended] to ‘abolish all corrupt practices and abuse of office.’ This imposes a fundamental obligation to ensure accountability for the spending of security votes by state governors,” the group also noted.

The statement further said, “The government has the primary and constitutional responsibility to protect the lives and property of the Nigerian people. Section 14(2)(b) of the Nigerian Constitution provides that ‘the security and welfare of the people shall be the primary purpose of government.’”

The suit was filed on behalf of SERAP by its lawyers — Kolawole Oluwadare and Ms Joke Fekumo.

“As revealed by a recent report by Transparency International (TI), most of the funds appropriated as security votes are spent on political activities, mismanaged or simply stolen. It is estimated that security votes add up to over N241.2 billion every year,” the suit said in part.

“On top of appropriated security votes, state governments also receive millions of dollars yearly as international security assistance.

“Articles 5 and 9 of the UN Convention against Corruption impose legal obligations on the government to ensure proper management of public affairs and public funds, and to promote sound and transparent administration of public affairs.

“While sitting state governors may enjoy immunity from arrest and prosecution, they do not enjoy immunity from investigation. Any allegations of mismanagement of security votes against sitting governors can and should be investigated pending the time they leave office and lose immunity.”

No date has been fixed for the hearing of the suit.

TCL’s 30 Series adds five new budget handsets in Europe starting at €139

TCL, the Chinese manufacturer best known for its lineup of smart TVs, has announced five new affordable Android smartphones as part of its 30 Series. Unlike the TCL 30 XE 5G and TCL 30 V 5G announced earlier this year for the US market, the five new handsets are focused on Europe, and their starting prices range from €139 to €249.

At the top of the new lineup is the TCL 30 5G, the only one of the new phones to support 5G. It’s got a 6.7-inch 1080p OLED display with a 13-megapixel selfie camera in a small teardrop notch, and around back it has a trio of cameras including a 50-megapixel main camera, a 2-megapixel depth sensor, and a 2-megapixel macro camera. It’s powered by a MediaTek Dimensity 700 chipset with a 5,010mAh battery, and will be priced starting at €249 when it goes on sale in Europe in April.

The TCL 30 5G sits at the top of the lineup.

Next up are the €199 TCL 30 Plus and €179 TCL 30. Both have the same 6.7-inch display and triple camera setup as the TCL 30 5G, but as their names suggest, they’re not 5G capable. The TCL 30 specifically also has a lower-resolution 8-megapixel selfie camera. Both are powered by a MediaTek Helio G37 processor, with 5,010mAh batteries, and are available now in Europe.

At the bottom of the lineup are the €149 TCL 30 SE and €139 TCL 30 E. They have smaller and lower-resolution 6.52-inch 720p displays, less powerful Helio G25 processors, and the TCL 30 E also lacks the 2-megapixel macro camera found on the rest of the lineup. But even these lower-cost handsets still include 5,000mAh batteries, use USB-C rather than older Micro USB connections, and, like the rest of the lineup, will ship with Android 12. The 30 SE is available now, while the 30 E will ship in Europe in April.

When TCL announced its first two 30 Series handsets in January, it said that it planned to launch a total of eight phones around the world over the course of 2022. With today’s announcement, seven of these eight phones are now public, with only a successor to last year’s TCL 20 Pro unaccounted for.

Chinese phone brands are carrying the torch for Europe’s biggest mobile show

Next week sees Mobile World Congress return to Barcelona, two years after the COVID-19 pandemic forced the cancellation of the world’s biggest mobile phone trade show, and one year after the show took place without many of its largest exhibitors in attendance. Not everyone is making a return to this year’s in-person event (Sony, Lenovo, and some media outlets including The Verge aren’t attending) but it almost feels like the show is back to full strength.

But it’s also an event that’s going to show off exactly how much the smartphone industry has shifted in recent years. As it stands, all the show’s biggest hardware announcements appear likely to come from Chinese brands like Oppo, Honor, TCL, Xiaomi-sub-brand Poco, and Huawei, rather than brands from Europe, America, or even another Asian country like South Korea.

Honor, for example, is planning to announce the Magic 4 series at the show, marking its first Western flagship smartphone launch since splitting with former parent company Huawei. Although the company released the mid-range Honor 50 globally last year, the Magic 4 is rumored to be using Qualcomm’s flagship Snapdragon 8 Gen 1 processor, making it a direct (and likely affordable) competitor to the likes of Samsung’s Galaxy S22 or the OnePlus 10.

Meanwhile Oppo has said it plans to announce “several high-end flagship products” alongside augmented reality and 5G “R&D achievements” at this year’s MWC. The company is fresh off the heels of announcing its latest flagship smartphone, the Find X5 Pro, last Thursday, but still intends to use this year’s show to make major announcements.

Or what about TCL, which says it plans to reveal more entries in its 30 Series of smartphones after announcing the first two entries, the 30 XE 5G and 30 V5G, at CES earlier this year. Or Poco, the Xiaomi sub-brand that plans to announce the Poco X4 Pro 5G and Poco M4 Pro at an event on February 28th. Oppo spinoff Realme is promising to announce the “world’s fastest smartphone charging technology” at this year’s show, which for those keeping track would need to be faster than the 125W UltraDart technology it announced a couple of years ago.

In contrast, major phone brands outside of China have rarely shown much interest in using MWC for major consumer-facing announcements. Google has never launched a smartphone at MWC, and Apple takes the show about as seriously as it takes every other major trade show, which is to say “not very.” But even Samsung, which used MWC to announce its flagship Galaxy S smartphone as recently as 2018, appears to be focusing its MWC launches this year on a humble laptop. Only HMD, the Finland-headquartered company that now produces Nokia-branded smartphones, has routinely timed its major product announcements with the Barcelona trade show.

MWC’s increasing focus on Chinese companies doesn’t mean it’s losing relevance, because these phones are more popular with customers all around the world than ever. As of last year, IDC reports that three out of the top five most popular smartphone brands worldwide — Xiaomi, Oppo, and Vivo — are headquartered in China, with the number one and two spots being taken up by Samsung and Apple. It’s a similar situation in Europe specifically, where Counterpoint Research reports that seven out of the top ten most popular smartphone brands are headquartered in China.

Instead, I think the trend is an interesting display of who has the most to gain from timing a big announcement to coincide with a crowded trade show. It’s not companies like Samsung and Apple, which have the kind of global physical presence that allows them to host big launches separately from major trade shows. But for a company like Honor or TCL, a show like MWC looks like an invaluable way to get a lot of press into one place to show off your wares.

The news around MWC 2022 will almost certainly be dominated by Chinese tech brands, who are doing the best out of anyone at keeping the buzz around Europe’s biggest mobile show alive. But the more you look at it, it starts to look like good logistics.

New Yorker convicted of death threats against Joe Manchin and Fox News hosts

A New York man has been convicted of making death threats towards US senator Joe Manchin and two Fox News hosts.

Military veteran Rickey Johnson, 48, was found guilty on Thursday in a Manhattan federal court of threatening a federal official and making interstate threats.

He was acquitted on one count of threatening a public official.

According to court documents, Johnson sent a private message to Fox News host Greg Gutfeld on 30 January, 2021, that read, “You will be killed.”

In public videos on social media, he also threatened Mr Manchin and Fox’s Laura Ingraham with death. In the clips, he claimed Joe Manchin was “dead” and would be “executed,” while he told Gutfeld he was “going to take [his] life.” In one video, he told Ingraham he would “kill” her with his “bare hands.”

“Rickey Johnson allegedly threatened to kill several cable news broadcasters and current and former US Senators and members of the House in rage-fueled posts on Instagram and in chilling private messages,” US Attorney for the Southern District of New York Audrey Strauss said in a statement when Johnson was arrested. “Among the many great freedoms Americans enjoy is the right to engage in political discourse, and disagreements are natural and healthy; but when invective metastasizes into threats of harm or even death, law enforcement will act swiftly to bring the person responsible to justice.”

Johnson also directed threats to Fox’s Jesse Waters and Florida governor Ron DeSantis.

“Rather than express his political differences constructively, Rickey Johnson escalated his discord by instilling fear,” US Attorney Damian Williams said in a statement on Friday after the conviction. He also praised the New York Police Department for their work on the case.

Law enforcement officials said there was no evidence of a specific plot to or weapons related to these threats, though the statements still were violations of law.

Johnson will be sentenced in May and could face up to 20 years in prison.

BREAKING: Nigeria’s Foreign Minister, Onyeama In Closed-door Meeting With Russian, Ukrainian Ambassadors

Nigeria’s Minister of Foreign Affairs, Geoffrey Onyeama is in a closed-door meeting with Russian and Ukrainian Ambassadors in Abuja.
The Muhammadu Buhari-led government has been under pressure to declare its position on the conflict in Ukraine, with many saying the government is too weak to choose a side.

SaharaReporters could not confirm what Onyeama is discussing with the Ambassadors at the time of filing this report on Friday.
Also after pressure from Nigerians, the minister on Thursday announced a special flight operation to evacuate Nigerian citizens from Ukraine given the escalating tension between that country and Russia.
Onyeama in an interview with NTA, said the Nigerian embassy in Kyiv had been contacted to make arrangements to get Nigerian citizens willing to leave Ukraine out.
The minister said the government would do everything to ensure the safety of Nigerians in Ukraine, particularly students.
“We are not going to take any chances, we have agreed that we are going to ask all Nigerians to stay in their residence and what we plan to do is once the airports are open, the embassy will assist those who are ready and willing to leave the country,” Onyeama said.
“There are five airports, so we are now planning to get those who want to leave to the airports nearest to where they are staying and assist for them to leave the country.”
Meanwhile, the House of Representatives also on Thursday demanded an immediate evacuation of Nigerians in Ukraine, offering to shoulder the responsibility.
This is a result of the ongoing row between Russia and Ukraine.

Again, Court Adjourns Hearing On Sowore’s Appeal Challenging Ruling on AAC Party Leadership

An Appeal Court sitting in Abuja has fixed April 4, 2022, for the hearing of an appeal filed by human rights activist, Omoyele Sowore, challenging a high court judgment on the leadership of the African Action Congress (AAC).

The judgment was delivered by Justice Inyang Ekwo of the Federal High Court in Abuja.

Sowore had in an appeal marked CA/A/812/2019, filed by the National Legal Adviser of the party and counsel for the activist, Inibehe Effiong, at the Court of Appeal prayed for the setting aside of Justice Ekwo’s judgment.

The case has suffered setbacks as a result of the delay tactics employed by 1st and 2nd respondents Leonard Nzenwa and Independent National Electoral Commission (INEC) respectively in the case.

At the resumed hearing of the case on Thursday, a new counsel for the 1st Respondent, R.O, Yusuf, after announcing his appearance, prayed the court for permission to file a respondent brief of argument within seven days.

The judge, however, challenged him for wasting the court’s time, adding that he ought to have filed the brief of argument immediately he took over the case instead of coming to court to seek permission.

The three-man panel headed by Justice A.J. Adah, therefore, granted the prayer as requested.

On his submission, Sowore’s lawyer, Effiong informed the court of the need to regularise their reply to 2nd respondent’s brief of argument.

He also prayed the court to consider a short adjournment since the case revolved around the leadership of the political party and considering the fact that INEC had issued guidelines for the next election.

The court, therefore, adjourned the case to April 4, 2022, for hearing.

Inibehe, while addressing journalists, said, “We came this morning for the hearing of the appeal against the judgement of federal high court delivered by Justice Inyang Ekwo in 2019.

“We had hoped that the appeal will be heard today because we have filed all our processes and served Leonard and INEC.

“When we came on Tuesday we were confronted with a notice of change of counsel. Every litigant has the right to determine who should represent him but as I indicated to the court when you have a team of lawyers representing you in a matter since 2019 and just at the peak of the case when the matter is to be heard, the person says I want to change my lawyers.

“I thought my lawyers had filed my brief. I was misled. I just realised they did not file and the person brings a new lawyer who comes into the matter and still does not file the brief but only asks for permission to file.

“Whereas he would have just filed as my learned justices of the court of appeal observed.

“That is why I said in the open court it is a delay tactic. You will observe at some point my Lords even made an observation that why didn’t you file. You would have just filed so that this appeal would have been heard. We know all these tactics are just to buy time.”

Putin tells Ukrainian military to ‘take power into own hands’ and overthrow Zelensky

Vladimir Putin has today called on the Ukrainian military to seize power in their country and overthrow President Volodymyr Zelensky.

The Russian president’s comments come as troops and tanks entered the capital of Ukraine, Kyiv, on Friday morning, amid continued heavy fighting with Ukrainian military forces.

At a televised meeting with Russia’s security council, Mr Putin said: “I once again appeal to the military personnel of the armed forces of Ukraine: do not allow neo-Nazis and (Ukrainian radical nationalists) to use your children, wives and elders as human shields.

“Take power into your own hands, it will be easier for us to reach agreement.”

Mr Putin added that Russian servicemen in Ukraine were acting “bravely, professionally and heroically.”

The second day of Russia’s assault on Ukraine has focused on the Ukrainian capital, where there has been intensive gunfire and explosions.

Ukrainian officials reported at least 137 deaths on the Ukrainian side and claimed hundreds on the Russian one. Russian authorities have released no casualty figures.

Mr Zelensky pleaded with Moscow to hold talks, and with western powers to act faster to cut off Russia’s economy and provide military help.

“When bombs fall on Kyiv, it happens in Europe, not just in Ukraine,” he said. “When missiles kill our people, they kill all Europeans.”

The Ukrainian president is believed to be in hiding as he is a key target for the Russia military.

More to follow…

Buhari Should Hand Over Power To Me, Says Tinubu

The national leader of the All Progressives Congress, Bola Tinubu has asked President Muhammadu Buhari to hand over power to him when he leaves n 2023.

The former Lagos governor had openly declared his intention to contest for President in 2023.

During his visit to the palace of the Ooni of Ife and Owa Obokun of Ijesaland, in Osun State, to seek their support, Tinubu said he stood with Buhari ahead of the 2015 election when he was contesting to be President.

“We went around the country in 2013 to campaign for Buhari. Again in 2019, we stood with him and he won,” he said.

“He will soon finish his tenure. I am saying they should not just leave the post; they should hand it over to me. I cannot demand it alone. I must seek your assistance.

“If monarchs in the region unite and ask for it, if we ask for the presidency gently that they should hand it over to us, I am ready to take over.

“I am competent, capable and fit to pilot the affairs of the country to greatness.”

Skin-maker Dbrand is permanently bringing back its leather phone skins

Gadget skin-maker Dbrand is announcing that its line of adhesive leather skins for smartphones and laptops are now available for sale once again, and this time, they will remain as a permanent fixture in its online store. The vegetable-tanned genuine leather skins first launched as a limited-edition run back in December and are now back due to popular demand. The 3M adhesive leather skins sell for around $34.95 for smartphones and $69.95 for laptops and are available in black, brown, and tan colorways for over 100 products, including the new Samsung Galaxy S22, iPhones, MacBooks, Google Pixels, and gaming consoles.

Dbrand says that these leather skins are made from full-grain cow leather, and they’re less than 0.5mm thick — though it will feel a bit thicker than your average adhesive skin. The skins have been created with a custom adhesive solution in collaboration with 3M that allows for bubble-free application and adhesive-free removal. Though applying a skin is not always an easy feat, Dbrand has a new installation tutorial video that also covers how to care for the leather and speed up the patina process.

For those that prefer keeping their phones in a case, the leather skins can also be purchased for Dbrand’s Grip Case if you want a leather accent attached to the back. And if that’s not enough of the leather lifestyle for you, Dbrand is also selling extras and oddities like a leather balm, leather keytag, and even a leather cube or pyramid.

With Apple’s recent leather cases leaving many disappointed and the relative rarity of good, high-quality leather case options for other devices, Dbrand’s skins might be the next best option. But if you’re looking for protection over a little extra grip and style points, you’ll want to go with the case option.
