Victims accuse R Kelly of ‘deplorable, inexplicable acts’ in harrowing sentencing impact statements

Victims of R. Kelly spoke out in court on Wednesday ahead of his sentencing, accusing the disgraced R&B singer of committing “deplorable, inexplicable acts” and destroying “so many people’s lives” while also demanding that the court has “your freedom taken from you.”

The 55-year-old bore witness to seven different impact statements from some of his victims while awaiting his sentencing in Brooklyn federal court. After a six-week trial last year, Kelly — born Robert Sylvester Kelly — was found guilty in September 2021 of all nine counts against him and charged with racketeering and violating the Mann Act, an anti-sex trafficking law.

In their remarks to the court, Kelly’s victims told of his “wickedness,” compared him to a Pied Piper who attracted children with fortune and fame, accused him of grooming and coaching “underage boys and girls for your own sexual gratification,” and said he “took away my innocence.”

Seven victims – Angela, Addie, Lizzette Martinez, Stephanie, Kitti Jones, Faith, and Sonja – appeared at the sentencing hearing in person to read portions of their statements.

The Independent has compiled excerpts of all the victim impact statements below:

Angela

“The Pied Piper of R&B, both in music and in technique and in approach.

“Success and love… you presented these glittering gems as if they were gold.

“With every addition of a new victim you grew in wickedness, cockiness, diminishing any form of humanity or self-awareness, which soon became the breeding ground for your God-like complex.

“You were doing, saying and encouraging despicable things that no one should be doing.

“We reclaim our names from beneath the shadows of your afflicted trauma. We are no longer the preyed-upon individuals we once were.

“I pray that God reaches your soul.”

Addie

“Writing this impact statement was hard.

“I never knew that going to that concert in September of 1994 was going to change me forever.

“These last four years have been a rude awakening of how my silence has hurt others.

“I hope Robert Kelly cannot sleep at night, knowing this is what he’s done.”

Lizzette Martinez

“January 1995 eventually changed me forever.

“I was left in shock, confused and in tears.

“[He] destroyed my young adult life… took away my innocence.

“I do not know how to put a price on all I’ve gone through. I am now 45, a mother and I struggle with mental health.

“Being abused doesn’t give you the right — you have no excuse.

“Robert, you destroyed so many people’s lives.”

Stephanie

“You were a 31-year-old pedophile ready to ruin another young woman’s life.

“What you did has left a permanent stain of my life I’ll never be able to wash away. Now it’s your turn, to have your freedom taken from you.

“I felt special, because someone who was special to the world was interested in me.

“I hope you go to jail for the rest of your life.”

Kitti Jones

“The secrets are out … I feel heard and believed.

“Many of us have been waiting for this day to come.”

Faith

“I hope you forgive yourself. I forgive myself.

“I hope you get some help, as well as ask God for forgiveness.”

Sonja

“There were numerous times I was scared for my life, scared for my daughter’s life.

In meetings with law enforcement to prepare for January 6, Trump lawyer Rudy Giuliani was warned of the potential threat of right-wing militia groups crashing the planned rally in Washington, according to a former White House aide.

“I recall hearing the word ‘Oath Keeper’ and hearing the word ‘Proud Boys’ closer to the planning of the Jan. 6 rally, when Mr Giuliani would be around,” Cassidy Hutchinson, who worked for White House chief of staff Mark Meadows, testified before the January 6 committee on Tuesday in pre-taped remarks.

Militia groups and white supremacists would later be among those who ransacked the Capitol building on January 6.

The mention of these right-wing groups was not the only foreboding thing ahead of the riots, Ms Hutchinson testified.

According to the former White House aide, Mr Meadows came away concerned from an early January, 2021, meeting with Mr Giuliani about what might happen on January 6.

“There’s a lot going on, Cass, but I don’t know, things might get real, real bad on January 6,” she testified.

The Independent is contacting Mr Giuliani and Mr Meadows for comment.

Airbnb permanently bans house parties from all listings

Airbnb has placed a permanent ban on all parties and events from occurring in its listings globally, after temporarily banning house parties in 2020 due to social distancing regulations from the Covid-19 pandemic.

On Tuesday, the homeshare company announced it will codify the plan as its official policy, after the temporary ban had effectively decreased the rate of unathourised party reports by 44 per cent.

“When the pandemic hit, as many bars and clubs closed or restricted their occupancy, we began to see some people taking partying behavior to rented homes, including through Airbnb,” the company said in a statement. “This was concerning to us due to both the disruptive nature of unauthorised parties and the risk of such gatherings spreading the virus. As such, we announced the party ban to our community as being ‘in the best interest of public health.’”

“Over time, the party ban became much more than a public health measure. It developed into a bedrock community policy to support our Hosts and their neighbours,” they said.

The ban prohibits disruptive events, open-invite gatherings shared on social media, and “party house” properties from occurring in Airbnb listings. It said the consequences for violating the policy varied from account suspension to full removal from the platform. In 2021, more than 6,600 guests were suspended from Airbnb for attempting to violate the party ban.

The updated policy will also remove a 16-person occupancy cap on Airbnb listings, which was temporarily placed due to the pandemic prior to the introduction of vaccines.

“Amazing properties like these thrive on hosting multi-generational family trips and larger groups, and removing this cap is meant to allow those Hosts to responsibly utilize the space in their homes while still complying with our ban on disruptive parties,” the company said.

The use of hidden cameras is also against Airbnb’s community standards, however a number of videos have recently gone viral of guests finding cameras hidden throughout rental properties. In order to spot hidden cameras and eavesdropping devices, look for tiny holes, shine a flashlight to reflect a camera lens, check the mirror, and scan for webcams.

ผู้ว่าชัชชาติควรบริหารจ่ายหนี้รถไฟฟ้าจากรายได้เชิงพาณิชย์ไม่ใช่จากเงินในกระเป๋าของเส้นเลือดฝอย และต้องไม่ต่อสัมปทานตามที่สัญญาไว้

ข่าวจากสื่อมวลชนเมื่อวานนี้ (27 มิ.ย 2565) ระบุว่าผู้ว่าชัชชาติเคาะค่าโดยสารรถไฟฟ้าสายสีเขียวตลอดสายไม่เกิน 59 บาท โดยคิดค่าโดยสารส่วนต่อขยาย (2 ) จากห้าแยกลาดพร้าวถึงคูคต และจากแบริ่งถึงสมุทรปราการ ด้านละ 15 บาท แต่ค่าโดยสารสูงสุดยังควรอยู่ที่ 44 บาท ไม่ใช่ 59 บาท เพื่อไม่เป็นภาระต่อผู้บริโภคที่เป็นเส้นเลือดฝอย
การเก็บค่าโดยสารส่วนต่อขยาย(2) แม้จะเป็นเรื่องชั่วคราวก็จริงอยู่ แต่ต้องไม่ใช่การขยายหรือต่อสัมปทานรถไฟฟ้าสายสีเขียวตลอดสายไปอีก 30ปีตามที่สื่อทีวีบางช่องออกมาตีความ

การแก้ปัญหาหนี้สินประมาณ 120,000 ล้านบาทที่มาจากค่าจ้างเดินรถ ระบบเชื่อมต่ออาณัติสัญญาณ และค่าก่อสร้างส่วนต่อขยาย(2) ผู้ว่าชัชชาติควรกำหนดนโยบายไว้เป็น 2 ระยะ คือ

1)ระยะที่1 ปัจจุบัน – 4 ธค. 2572 (วันที่รถไฟฟ้าสายสีเขียวส่วนหลักหมดสัมปทาน)

(1.1) เก็บค่าโดยสารส่วนต่อขยาย ( 2 )ในราคาด้านละ 15บาท และค่าโดยสารสูงสุดตลอดสายอยู่ที่ 44 บาท

(1.2)ควรเจรจากับบีทีเอสให้แก้ไขสัญญาว่าจ้างเดินรถของรถไฟฟ้าส่วนหลัก ส่วนต่อขยาย(1) และ ส่วนต่อขยาย (2) จากปี2585 ให้จบที่ปี 2572 เพราะสัญญาจ้างเดินรถทั้งหมดมีมูลค่าหลายแสนล้านบาท และเป็นการทำสัญญาจ้างเดินรถโดยไม่ได้เข้าพรบ.ร่วมทุนฯ ทำให้เกิดคำถามว่าชอบด้วยกฎหมายหรือไม่ และเป็นการเอื้อประโยชน์ให้กับบริษัท
บีทีเอสเพียงเจ้าเดียว ใช่หรือไม่

กรณีนี้ทราบว่ายังอยู่ในการสอบสวนของป.ป.ช และหากผลออกมาว่าการทำสัญญาว่าจ้างการเดินรถถึงปี 2585 เป็นเรื่องที่ไม่ชอบด้วยกฎหมาย เป็นการเอื้อประโยชน์ให้กลุ่มทุนโดยไม่ได้ผ่านการประมูลตามพรบ.ร่วมทุนฯ จะทำให้การจ่ายหนี้การจ้างเดินรถเป็นเรื่องผิดกฎหมายไปด้วยใช่หรือไม่ และผู้ว่าชัชชาติก็อาจจะมีความผิดไปด้วยหรือไม่?
ทราบมาว่าบีทีเอสต้องการได้หนี้ค่าจ้างเดินรถและค่าเชื่อมต่ออาณัติสัญญาณประมาณ 35,000 ล้านบาทคืนโดยเร็ว สิ่งที่ผู้ว่าชัชชาติควรดำเนินการอันดับแรก คือการเปิดเผยสัญญาการจ้างเดินรถถึงปี 2585 ให้ประชาชนทราบ และเจรจาให้บีทีเอสแก้ไขสัญญาว่าจ้างการเดินรถจากปี 2585 ลงมาจบที่ปี 2572 เพื่อจบปัญหาความไม่ชอบด้วยกฎหมายของสัญญาจ้างเดินรถ การจ่ายหนี้สินค่าจ้างค่าเชื่อมต่ออาณัติสัญญาณก็จะเป็นไปได้ แทนที่จะยืดเยื้อเป็นปัญหาของทั้งสองฝ่าย

(1.3)การจ่ายหนี้ส่วนต่อขยาย(2) แก่บีทีเอสจำนวนประมาณ 35,000 ล้านบาท ผู้ว่าชัชชาติสามารถทำได้หลายวิธี เช่น (ก) ของบประมาณรัฐบาลมาอุดหนุน (ข) ขอยืมงบประมาณรัฐบาล แล้วชำระคืนเป็นรายปี (ค) ยกส่วนต่อขยาย(2)พร้อมหนี้คืนให้กระทรวงคมนาคม (ง)ใช้รายได้เชิงพาณิชย์และการโฆษณาในสถานีของส่วนต่อขยาย(2) ซึ่งมีจำนวน 25 สถานี มาจ่ายหนี้ด้วยการออกตราสารหนี้ (securitization)ระดมทุนประมาณ 36,000ล้านบาทโดยบริษัทกรุงเทพธนาคมเพื่อคืนบีทีเอส และกรุงเทพธนาคมสามารถคืนหนี้ให้ผู้ลงทุนภายในเวลา 15-20 ปี ด้วยอัตราดอกเบี้ย 2.5-3%/ปี

(1.4) เปิดการประมูลว่าจ้างเอกชนเดินรถไฟฟ้าสายสีเขียวตลอดสายหลังปี 2572 ด้วยพรบ.ร่วมทุนฯ ได้ภายในปี 2567 โดยกำหนดราคาสูงสุดตลอดสายไม่เกิน 25บาท ซึ่งจะเป็นไปตามที่ผู้ว่าชัชชาติเคยประกาศไว้

(1.5)เจรจากับกระทรวงการคลังผ่อนจ่ายหนี้ค่าโครงสร้างส่วนต่อขยาย(2) หลังปี 2572 โดยใช้รายได้จากค่าเช่าพื้นที่เชิงพาณิชย์และค่าโฆษณาในรถไฟฟ้าสายหลัก 23สถานี+ ส่วนต่อขยาย(1)อีก 11สถานีรวมเป็น 34 สถานี

2)ระยะที่2 หลัง4ธค.2572

(2.1)หลังปี2572 เมื่อรถไฟฟ้าส่วนหลักหมดสัมปทาน ค่าโดยสารควรจะถูกลงเหลือ 20-25 บาท ตามการประมูลว่าจ้างเดินรถ เพราะจะเหลือแค่ค่าใช้จ่ายการเดินรถและค่าบำรุงรักษา ไม่มีค่าใช้จ่ายส่วนของค่าโครงสร้างระบบรางอีกแล้ว

(2.2) กทม.ใช้รายได้เชิงพาณิชย์ของสถานีหลักหลังหมดสัมปทาน ปี2572 และสถานีส่วนต่อขยาย (1) ซึ่งจะมีรายได้ปีละไม่ต่ำกว่า 5,000 ล้านบาท เพื่อจ่ายคืนหนี้ค่าโครงสร้างพื้นฐานส่วนต่อขยาย (2)ให้กระทรวงการคลัง
การแก้ปัญหาเรื่องหนี้ค่าจ้างเดินรถ และหนี้อื่นๆนั้น ด้านหนึ่งก็เป็นโจทย์ทางคณิตศาสตร์ ที่แก้ได้หลายวิธี อยู่ที่ว่าแก้โจทย์แล้วให้ใครได้ประโยชน์สูงสุด

วิธีที่เสนอให้แก้หนี้ด้วยการ securitize รายได้เชิงพาณิชย์ล่วงหน้าเป็นการคำนึงถึงประโยชน์สูงสุดให้กับผู้บริโภค ที่เป็นเส้นเลือดฝอยเพราะสามารถแก้หนี้ได้โดยไม่ต้องล้วงกระเป๋าผู้บริโภคมาจ่ายหนี้ผ่านค่าโดยสารราคาแพงไปอีก 30 ปี

ระบบสัมปทานคือการแก้ปัญหาหนี้ที่ให้ประโยชน์สูงสุดกับเจ้าสัว แต่สร้างภาระให้ผู้บริโภคต้องจ่ายค่าโดยสารราคาแพงไปอีก 30 ปี แทนที่จะจ่ายค่าโดยสารตลอดสายสูงสุดได้ในราคา 20-25 บาท และในระบบสัมปทาน ผลประโยชน์เชิงพาณิชย์มูลค่าประมาณปีละ 8 พันล้านบาทจะตกเป็นของเจ้าสัวไปอีก 30 ปีด้วย ใช่หรือไม่

สิ่งที่ผู้ว่าชัชชาติประกาศทั้งก่อน และหลังเลือกตั้งว่าการประมูลเรื่องรถไฟฟ้าสายสีเขียวต้องใช้ พรบ.ร่วมทุนฯ ซึ่งจะทำได้ต่อเมื่อรถไฟฟ้าสายสีเขียวส่วนหลักหมดสัมปทานในปี 2572 และผู้ว่าสามารถเจรจาแก้ปัญหาสัญญาจ้างเดินรถถึงปี 2585 มาเป็น 2572 เพื่อจะเปิดโอกาสการประมูลจ้างเดินรถสายสีเขียวตลอดสายด้วย พ.ร.บ.ร่วมทุนฯได้ และจะได้ราคาอยู่ที่ 25-30 บาทตามที่ท่านชัชชาติได้พูดสัญญาเอาไว้

ถ้าผู้ว่าชัชชาติเลือกแก้ปัญหาหนี้ด้วยวิธีต่อสัมปทาน ก็จะผิดคำพูดที่ประกาศไว้ว่าจะใช้ พ.ร.บ.ร่วมทุนฯในการประมูล และย่อมจะทำให้ชาว กทม.เกิดคำถามได้ว่าเป็นการบริหารที่โปร่งใส ไร้การเอื้อประโยชน์ หรือไร้ผลประโยชน์ต่างตอบแทน หรือไม่ และเป็นการเข้าข่ายทุจริตเชิงนโยบาย หรือไม่

การบริหารอย่างโปร่งใส ชาญฉลาดต้องช่วยให้ผู้บริโภคจ่ายค่าโดยสารถูกลงหลังหมดสัมปทานในปี 2572 ไม่ควรใช้การต่อสัมปทานไปอีก 30 ปี มาแก้ไขหนี้สิน ซึ่งเป็นการล้วงเงินจากกระเป๋าผู้โดยสารมาใช้หนี้ แบบเอาเนื้อหนูไปปะเนื้อช้าง และยังยกรายได้เชิงพาณิชย์จากรถไฟฟ้าสายสีเขียวตลอดทั้งสาย 59 สถานีให้เจ้าสัวไปอีก 30 ปีด้วย

เมื่อค่าโดยสารรถไฟฟ้าถูกลง จะช่วยให้ผู้บริโภคในระดับเส้นเลือดฝอยสามารถใช้รถไฟฟ้าเป็นขนส่งมวลชนได้อย่างแท้จริง และช่วยให้ลดปริมาณการใช้รถบนท้องถนนลงได้ มีผลช่วยให้อากาศสะอาด ลดฝุ่น PM2.5 ได้อย่างเป็นรูปธรรม

อย่างไรก็ดี ผู้โดยสารรถไฟฟ้าสายสีเขียวก่อนปี 2572 ยังคงต้องจ่ายค่าโดยสารสูงสุดในระบบเดิม ที่ราคา 44 บาทไปก่อน โดยคาดหวังได้ว่าหลัง 4 ธันวาคม 2572 ราคาค่าโดยสารตลอดสายของรถไฟฟ้าสายสีเขียวจะลดลงเหลือ 20 บาท สูงสุดไม่ควรเกิน 25บาทตลอดสาย

ซึ่งเป็นโครงสร้างราคาที่เป็นธรรมแก่ผู้บริโภคในระบบขนส่งมวลชนอย่างแท้จริง

Emma Raducanu and Andy Murray are both in action on the opening day of Wimbledon this afternoon as the two stars of the British game highlight a packed schedule of matches in SW19.

Raducanu and Murray both issued positive injury updates ahead of the tournament and are ready to go as the Championships return in front of full crowds and without Covid-19 restrictions.

Raducanu will be making her Centre Court debut following her stunning US Open triumph last September and her breakthrough run to the fourth round at last year’s tournament, but she faces a tricky opponent and a grass-court specialist in Alison Van Uytvanck.

I Won’t Quit Politics Despite Losing APC Primary To Ex-Governor Tinubu – Osinbajo Tells Supporters

After his failed bid to succeed President Muhammadu Buhari in the 2023 general elections, Vice President Yemi Osinbajo has said he will remain in active politics.
Osinbajo further noted that he would continue to push for a better Nigeria.

He stated this while addressing “representatives of the Diaspora Professionals for PYO” in a virtual meeting, a statement by his media aide Laolu Akande said.
“I intend to stay very actively engaged in the politics of our country, because I believe strongly that, if God gives us that opportunity, the change will be swift and we will make a real difference.
“We must continue to push. If we give up and say let’s see how it goes, we will be much further back than where we started from.”
Some weeks ago, the All Progressives Congress held a special convention to elect a presidential candidate for the APC in the 2023 general elections at the Eagles Square in Abuja.
However, Osinbajo came third behind former Lagos governor, Bola Tinubu, and ex-transport minister, Rotimi Amaechi.

Gareth Bale agrees to join Los Angeles FC following Real Madrid exit

Wales forward Gareth Bale has agreed to join Major League Soccer side Los Angeles FC on an initial one-year deal when his contract with Real Madrid expires, the PA news agency understands.

The five-time Champions League winner is soon to be a free agent and is looking for a new club ahead of playing for Wales at the World Cup in Qatar, which starts in November.

Bale, 32, had been linked with a move to hometown club Cardiff following the end of a nine-year stay at Real Madrid, but he now appears set to continue his career with a move to the United States.

While there has as yet been no official comment from LAFC, the MLS club had posted a cryptic message on Twitter appearing to tease an imminent announcement, writing “Any guesses?” to a GIF showing LAFC international mail.

Last week, Bale had excited Cardiff fans by visiting the Sky Bet Championship club’s Vale of Glamorgan base on their first day of pre-season training.

Wales captain Bale had fuelled speculation he might prefer being closer to home following comments that the standard of football he played before the World Cup should not prove a decisive factor in any move.

It is understood Bale – reportedly having earned around £600,000 per week at Real Madrid – had several options on the table, with former club Tottenham and big-spending Newcastle also suggested as potential destinations.

Speaking while on recent international duty with Wales, Bale said: “I don’t really know if the standard makes too much of a difference. A football game is a football game.

“I feel like I’ll never really lose my quality on the ball. I guess it’s a conversation to be had.

“I need time to think what’s the best move for me, my family, my kids, and hopefully we’ll sort that over the summer. I have options.”

Bale’s move to the MLS is expected to also include the option of an 18-month contract extension, and would see him join former Italy captain Giorgio Chiellini as part of the LAFC squad.

LAFC have been approached for further comment by PA on Saturday.

Parties Can Substitute Vice-Presidential Candidate Only In Case Of Death Or Voluntary Withdrawal — Electoral Body, INEC

The Independent National Electoral Commission has given conditions by which political parties can substitute the names of validly nominated candidates.
According to INEC, the law does not permit political parties the right to replace the names of candidates whose names have been forwarded to the commission.

This comes amid speculations that some political parties nominated placeholders while talks are ongoing for selection of substantive candidates.
The All Progressives Congress reportedly picked forwarded the name of Ibrahim Kabiru Masari as its vice-presidential candidate, while the Labour Party nominated Doyin Okupe.
Speaking on the issue, the INEC National Commissioner, Festus Okoye, said the electoral body would decide in accordance with the Electoral Act.
He said while appearing on Channels TV on Friday, “As far as the law is concerned and as far as the commission is concerned, the commission makes it mandatory that the moment a presidential candidate emerges, such a presidential candidate must nominate an associate who shall run with him/her as a vice-presidential candidate. And so, both are seen as Siamese twins; they move together, and they fall together.
“In the forms submitted by the various political parties, they submitted forms relating to their presidential candidates and they also submitted forms relating to their vice-presidential presidential candidates, and that is in compliance with the provisions of the constitution and in compliance with the provisions of the law.”
Okoye explained further, “There is a provision in the Electoral Act for withdrawal of candidates validly nominated and the law provides that a political party cannot substitute a candidate that has been validly nominated except in two instances; if the nominated candidate dies or if the nominated candidate withdraws from the race.
“And in terms of withdrawal, the nominated candidate shall – in his own writing – write a letter to the political party that nominated him, indicating that he has withdrawn from the race and that must also be accompanied by an affidavit duly sworn to by the said candidate.
“Then the political party that nominated the candidate will now forward same to the Independent National Electoral Commission saying that our presidential candidate has withdrawn, or our vice-presidential candidate has withdrawn, and these are the documents of withdrawal and this is the person we are using to replace.
“But as of today, the political parties nominated their presidential candidates and nominated their vice-presidential candidates, so the issue of withdrawal is at the absolute discretion of the duly nominated candidate and no one else.”
According to Okoye who is also INEC’s Chairman of Information and Voter Education Committee, the political parties submitted forms containing the names of their presidential and vice-presidential candidates, as well as their particulars and sworn affidavits.
He stressed that none of the political parties indicated that they were submitting the document or name of a candidate as a placeholder.
“All the political parties that submitted list and particulars of their candidates said they were submitting the list of their presidential candidates and vice-presidential candidates; the issue of submitting a name in lieu, or submitting a name as a placeholder did not even arise,” the INEC official stated.

วันที่ 25 พ.ค. 2565 ศูนย์ทนายความเพื่อสิทธิมนุษยชน เผยว่า เมื่อ 23 มิ.ย.ที่ผ่านมาได้รับแจ้งคำสั่งไม่ฟ้องคดีอย่างเด็ดขาดของพนักงานอัยการพิเศษฝ่ายคดีอาญา 4 ในคดีของ “เพนกวิน” หรือนายพริษฐ์ ชิวารักษ์ ที่ถูกกล่าวหาในข้อหา ดูหมิ่นศาล กรณีโพสต์วิพากษ์วิจารณ์คำวินิจฉัยของศาลรัฐธรรมนูญ เรื่องการพักอาศัยในบ้านพักข้าราชการทหารของ พล.อ.ประยุทธ์ จันทร์โอชา โดยอัยการวินิจฉัยว่าคดีพยานหลักฐานยังไม่เพียงพอยืนยันได้ว่าผู้ต้องหาเป็นผู้โพสต์ข้อความตามที่ถูกกล่าวหา

คดีนี้มี นายเชาวนะ ไตรมาศ เลขาธิการสำนักงานศาลรัฐธรรมนูญ มอบอำนาจให้ ส.ต.ท.มนตรี แดงศรี มาเป็นผู้กล่าวหาพริษฐ์ ในข้อหาตามประมวลกฎหมายอาญา มาตรา 198 “ดูหมิ่นศาลหรือผู้พิพากษาในการพิจารณาหรือพิพากษาคดี หรือการกระทำการขัดขวางพิจารณาหรือพิพากษาของศาล” จากกรณีโพสต์เฟซบุ๊กเพจมีข้อความวิพากษ์วิจารณ์ศาลรัฐธรรมนูญ 2 ข้อความ ในช่วงวันที่ 2 ธ.ค. 2563 หลังจากศาลมีคำวินิจฉัยให้ พล.อ.ประยุทธ์ จันทร์โอชา ไม่ขาดคุณสมบัติความเป็นนายกรัฐมนตรี จากกรณีพักอาศัยในบ้านพักข้าราชการทหารแม้เกษียณอายุไปแล้ว

ล่าสุด พนักงานอัยการ สำนักงานอัยการพิเศษฝ่ายคดีอาญา 4 ได้มีคำสั่งไม่ฟ้องคดีนี้อย่างเด็ดขาดเมื่อวันที่ 27 พ.ค. 2565 แจ้งมายังพนักงานสอบสวนสน.ทุ่งสองห้อง

เนื้อหาคำวินิจฉัยที่เห็นควรสั่งไม่ฟ้องคดีนี้ ระบุว่าคดีข้อเท็จจริงรับฟังเป็นยุติตามคำให้การของ พ.ต.ต.กิตติพงศ์ อมฤตโอฬาร สารวัตรกองกำกับการ 3 กองบังคับการป้องกันและปราบปรามอาชญากรรมทางเทคโนโลยี ผู้ทำการสืบสวนและทำรายงานผลการตรวจสอบบัญชีเฟซบุ๊กชื่อ “เพนกวิน-พริษฐ์ ชิวารักษ์ Parit Chiwarak” ให้การยืนยันว่า IP Address ที่ใช้โพสต์ข้อความดังกล่าวนั้น มีผู้ใช้งานในเวลาเดียวกันจำนวน 232 ราย แต่ไม่สามารถตรวจสอบข้อมูลผู้ลงชื่อเข้าใช้งานและหมายเลข IP Address ของบัญชีดังกล่าวได้ เนื่องจากผู้ให้บริการเป็นของ Facebook ซึ่งมีที่ตั้งอยู่ต่างประเทศ

ประกอบกับบัญชีเพจเฟซบุ๊กดังกล่าว มีผู้ดูแลเพจหลายคน ซึ่งไม่สามารถตรวจสอบได้ว่าเป็นบัญชีของผู้ใดบ้าง จึงไม่สามารถยืนยันว่าบัญชีใดเป็นผู้โพสต์ข้อความดังกล่าว และมีความเกี่ยวข้องกับผู้ต้องหาอย่างไร การตรวจสอบดังกล่าว ไม่สามารถยืนยันได้ว่าผู้ต้องหาเป็นคนโพสต์ข้อความดังกล่าว คดีพยานหลักฐานไม่พอพิสูจน์การกระทำความผิดของผู้ต้องหา

สำหรับข้อความดังกล่าวนั้น เมื่อวันที่ 2 ธ.ค. 2563 เฟซบุ๊ก “เพนกวิน – พริษฐ์ ชิวารักษ์ Parit Chiwarak” ได้โพสต์ข้อความโดยการเปิดโพสต์สาธารณะ ระบุว่า “ไม่ใช่แค่ขอแจก…ให้ประยุทธ์ ให้ศาลรัฐธรรมนูญ แต่ขอแจกให้ทุกตัวในคอกสุนัข รวมถึง….ด้วย”

Despite Video Evidence, Peter Obi Denies Saying $20m Investment Made For Anambra Now Worth $100m, Blames Supporters For ‘Fake News’

The presidential candidate of the Labour Party (LP), Peter Obi says he never claimed Anambra state’s investment in SABMiller was now worth $100m.

 

Obi disclosed this in a letter signed by his media aide, Valentine Obienyem to Governor Chukwuma Soludo on Thursday.

The former governor had claimed in an interview with Arise TV in 2018 that he invested over $20 million in International Breweries on behalf of Anambra state, and that the investment was worth almost $100 million at the time.

 

In the viral interview, Obi had said, “Tomorrow, they are commissioning a facility in Sagamu, International Breweries, the biggest brewery in Africa. Anambra state is the single highest shareholder in that facility, I invested in it – over 20-something-million dollars. It is worth almost $100 m today, that’s what governments should do.”

 

The claim was however debunked by Governor Soludo.

 

Last Monday, the governor debunked reports that a ‘$20 million investment’ made by Obi was now worth $100 million.

 

A Facebook user had also credited a statement to Soludo alleging that the $20 million which Obi allegedly invested on behalf of the state in the company is now worth $100 million.

 

“Mr Peter Obi’s $20 million investment in Anambra worth $100 million today – Charles Chukwuma Soludo,” the Facebook user had said.

 

Reacting to the claim on his verified Facebook page, Soludo said, “Where did you read or hear me make such false statement? This fake news has been roundly debunked by my team.

 

“We can carry on with campaigning for our preferred candidates without consciously misleading the reading public. The report is fake and never emanated from me. Thank you.”

 

International Breweries (IB) Plc is a subsidiary of the world’s largest brewer, Anheuser-Busch InBev (AB InBev) — a multinational drink and brewing giant based in Leuven, Belgium. SABMiller, a South African multinational brewing and beverage company was acquired by AB InBev in October 2016.

AB InBev merged its Nigerian operations under a single corporate entity in 2017.

In a letter to the governor, Obi said he had nothing to do with the exaggeration of the state’s investment in the company despite the viral Arise TV interview.

 

He blamed some of his supporters “not under his control but eager to throw in anything that glorified their hero — Obi.”

 

Obi said Soludo’s emergence as governor gave Anambra people hope that the state would rise again, pledging to offer the governor all the support he needed to succeed.

 

The letter read, “When the news of the multiplication of Obi’s investment in SABMiller was published, I knew it did not come from you. I personally made it clear that it was not circulated by Obi’s Media, but probably by one of the youths, not under our control, but eager to throw in anything that glorified their hero–Obi.

 

“Do not judge Obi’s supporters based on these people’s cathartic reactions. It was saddening when one of the people you later appointed an aide, in a bashful, pugilistic manner, said I was the one that published it. When your media aide rebutted it, I said he did what he was supposed to do.

 

“My argument was simple: Even if the news was true, it is wrong to put into your mouth what you did not say. I read the recent rebuttal by your Commissioner on the subject, what do I say about it? I only want to assure you that Obi’s camp is supporting you. We want you to succeed and cannot be part of any plot against you.

 

“Some people are angry because we have chosen to identify with you; it is about time they realised that our only interest is recovering the eight years of retrogression.

 

“Anybody supporting Obi that fights you is on his own. I say this with all sincerity, especially knowing the brief I personally received from Mr. Peter Obi on this. Obi is ready to offer any support that will redeem our state and set it on the path of progress again.

 

“The way things are, anybody fighting you at the January of your tenure is simply being inconsiderate and insensitive. Please always sieve everyday reactions by people from the reaction from Mr. Obi’s official camp. As for Soludo’s supporters, take us as friends. We are one with you in the belief that Prof. Soludo should succeed for the good of our state.”

Human rights lawyer and Senior Advocate of Nigeria (SAN), Femi Falana has said the ruling All Progressives Congress (APC) breached the provisions of the newly enacted Electoral Act by submitting the names of Ahmad Lawan and Godswill Akpabio to the electoral body, Independent National Electoral Commission (INEC) as senatorial candidates.

Falana, who is a principal partner at Falana & Falana Chambers, said it was “brazen impunity” for the APC to have contradicted the laws of the land.

This was disclosed in a statement issued on Wednesday on the development.

The statement reads: “Apart from the brazen impunity of the APC, Dr. Ahmed Lawan superintended the passage of the Electoral Act by the national assembly while Senator Godwin Akpabio is a senior lawyer who ought to have familiarised with the provisions of the Act.”

According to Falana, “any primary of a political party not monitored by officials of INEC is illegal”.

He noted that “Section: 84 (13) unequivocally provides that ‘Where a political party fails to comply with the provisions of this Act in the conduct of its primaries, its candidate for election shall not be included in the election for the particular position in issue’.

Falana continued, “The legal implication of the provision is that INEC shall not include the candidate for the particular election. Furthermore, Section 29 (1) of the Electoral Act, 2022 which provides for the submission of lists of candidates and their affidavits by political parties states that ‘Every political party shall, not later than 180 days before the date appointed for a general election under this Act, submit to the Commission, in the prescribed Forms, the list of the candidates the party proposes to sponsor at the elections, who must have emerged from valid primaries conducted by the political party’.

“This means that section 29(1) thereof has imposed a duty on political parties to ensure that the candidates whose names are submitted to INEC have emerged from valid primaries.

“This position is quite different from the provision in Section 31 of the repealed Electoral Act 2010 (as amended) which provided that INEC could not reject the name of any candidate submitted by the parties for any reason whatsoever.

“Thus, in the present law, the parties can only submit for the Commission’s acceptance the names of candidates who emerged from valid primaries conducted by the parties and monitored by INEC. This position is clearly fortified by Section 84(13).

“Thus, INEC having sent a team of monitors across its 36 states offices and the Federal Capital Territory, to monitor the primaries, is legally obligated to check the names submitted to it and ensure they are confirmed by the various reports compiled by its officials.

“If the candidates whose names are submitted to INEC have not emerged from the primaries, the Commission will reject such names in the exercise of its power under Section 84(13) of the Electoral Act 2022.”

 

SaharaReporters had reported that the APC had submitted the names of Lawan, Senate President, and Akpabio, a former Minister of Niger Delta Affairs to INEC as APC senatorial candidates for Yobe North senatorial district and Akwa Ibom North-West respectively even though the duo did not secure the tickets of the party.

It was Bashir Machina who won the party’s ticket for Yobe North senatorial district while Udom Ekpoudom won the primaries for Akwa Ibom North-West, but the names of the winners were not submitted by the ruling party.

Abdullahi Adamu, the National Chairman of the APC recently said Lawan participated in the primary “within the stipulated time”, while Jackson Udom, spokesman for Akpabio, had maintained that the primary the former minister won was approved by the party at the national level.

However, there have been speculations that both candidates may have issues regarding the tickets.

Falana said the only way the APC can present Akpabio and Lawan as its senatorial candidates is if Machina and Ekpoudom “voluntarily withdraw”.

Machina Is Crazy, APC’s Decision To Go With Lawan Is Final, National Chairman, Adamu, Lambasts Yobe North Senatorial Candidate

The National Chairman of the ruling All Progressives Congress (APC), Abdullahi Adamu, has threatened severe sanctions against the winner of the Yobe North senatorial ticket, Bashir Sheriff Machina for refusing to relinquish his ticket to the Senate President, Ahmad Lawan.
Adamu warned Machina to desist from making further inflammatory comments against the party’s decision to field Lawan as its senatorial candidate for Yobe North.

The National Chairman argued Wednesday, that the party is supreme and that it reserves the right to decide who gets its ticket in any election.
He said, “There’s nothing in the law stopping the Senate President from contesting for another nomination just because he lost a presidential bid.
“Machina is crazy and needs to get back to his senses immediately.
“He (Machina) should also be warned to stop inflaming the polity else we’ll not hesitate to take measures; Ahmad Lawan is our candidate for Yobe North,” he said.
SaharaReporters has consistently reported the impasse with updates including how Machina claimed his life was under threat for refusing to step down for Lawan after the Senate President failed to clinch the APC presidential ticket.
Machina has refused to give up his nomination saying, “I’m certainly in the race for Yobe North Senatorial seat.
“I was never contacted directly by the Senate President on the matter, even if I was, I have the exclusive right to concede or not,” he said.
Commenting on the situation, a Yola-based legal expert, Joshua Wugira mocked the APC for submitting Lawan’s name to the Independent National Electoral Commission (INEC), describing it as an exercise in futility.
According to him, if Lawan wins in the general elections, his victory will be upturned by the court.
He said, “The law is explicitly clear, no one can participate in an election without first being a product of a proper nomination process.
“Unfortunately for the country, the man at the centre of it all is the number one lawmaker in Nigeria, who should know better, having been in the National Assembly for 23 years now.
“Machina should stick to his gun in the interest of democracy and go to court. In the end, APC’s dictatorial democracy would not stand the law.”

Uvalde victim’s sister begs Texas lawmakers for gun reform: ‘Do something’

The teenage sister of a nine-year-old girl killed in the mass shooting in Uvalde has begged Texas lawmakers to pass gun control laws as she broke down in tears revealing she is now “terrified” to return to school for her final year.

Jazmin Cazares gave heartbreaking testimony before the Texas Legislature on Thursday morning where she described losing both her younger sister Jacklyn and her cousin Annabell Rodriguez in the 24 May massacre at Robb Elementary School.

Wearing a shirt with her little sister’s photo on, she said she was there to honour those killed in the attack and challenged lawmakers that “you can honour them too by passing gun safety legislation”.

“I’m here begging for you guys to do something and to change something because the people who were supposed to keep her safe at school didn’t,” she said.

“They failed.”

She called for Texas lawmakers to pass legislation on background checks in order to “proetct innocent communities like mine from being endangered by people who are unstable and signal that they are threats”.

“There should be absolutely no reason this murderer should have been able to have access to a firearm,” she said.

“Days after turning 18, he bought an AR-15, hundreds of rounds of ammunition.”

Through her grief, the teenager spoke of being “terrified for her life” as she decides whether to return to school to complete her studies in the next academic year.

“Am I going to survive?” she asked.

When asked about active shooter drills, Ms Cazares said that her school often went into lockdowns so “no one ever usually took it seriously – until that day”.

“We were in lockdown so the only information we were getting was from the media,” she said.

“It was terrifying… and having to go back to school next year… I don’t know.

“It’s a really big decision and going to school shouldn’t have to be a big decision but it is. I’m terrified for my life to go back.

“I have senior year and that’s it. Am I going to survive it?” she asked.

Jacklyn – nicknamed “Jackie” – was one of 19 young students aged between nine and 11 years old who were killed alongside two teachers in the worst school shooting in America since Sandy Hook in 2012.

Ms Cazares choked up with emotion as she paid tribute to her little sister as “an exact copy of me” who “loved singing and dancing and acting”.

Instead of being home together enjoying the summer break as they should be, she had to be there today to call on lawmakers to prevent other families from being torn apart by gun violence.

“I’m not supposed to be here right now. I’m supposed to be at home watching a movie with my sister. It’s summer,” she said.

Jackie had wanted to go to Paris for her graduation, Ms Cazares told the lawmakers. She now plans to go in her sister’s honour when she graduates from school next year.
